Industrial Court Awards RM703K for Unfair Dismissal Case

We are pleased to share a recent success story from our firm, which has also garnered media attention.

On July 16, 2024, the Industrial Court ruled in favor of our client, the Claimant, in an unfair dismissal case. The Court found that our client had been unfairly dismissed by his employer, a telco company, and awarded a total compensation of RM703,664.00.

Our client dedicated 25 years of loyal service to the Company before being terminated on grounds of alleged poor performance. Before the dismissal, the Claimant was placed under a Performance Improvement Program (PIP) for three months. The Court held that the termination was without just cause or excuse.

The Court’s decision was based on a thorough analysis of various evidence and facts. This included examining the circumstances leading to the Claimant being placed under the PIP, the manner in which the PIP was conducted, and the feasibility of the performance targets set for the Claimant. Notably, the Court considered that the Claimant had never received any warning letters for poor performance nor faced any disciplinary actions in his 25-year tenure. We commend the Court for its meticulous review of evidence and for providing clear guidance on the relevant legal principles.
